Customer sues McDonald’s restaurant after getting burnt from hot coffee; similar lawsuit was filed in the 1990s

A McDonald’s restaurant in San Francisco is being sued for allegedly serving hot coffee without properly attaching the lid.
The plaintiff claims that while she was trying to drink coffee, the contents spilled on her body, causing ”severe burns.”

The lawsuit was filed last week
Plaintiff Mabel Childress claims she suffered ”physical pain, emotional distress, and other damages,” and that the store’s negligence was a ”major contributing factor” to her burns.

Childress also claimed that store employees ”refused” to help her.
McDonald’s denies this

This lawsuit is reminiscent of a 1990s lawsuit over McDonald’s hot coffee.
In this case, another woman spilled coffee on her lap and suffered third-degree burns.

According to the American Tort Law Museum, the jury accepted the woman’s claim that the coffee was unreasonably hot.
This coffee was said to be 30 to 40 degrees hotter than coffee served by other companies.
The plaintiff was initially awarded nearly $3 million in damages, but the case was settled in a higher court for about $480,000.
